Judge C. Vernon Mize Jr.

said Tuesday, "I determined, that in my opinion, a seatbelt defense does not apply to death cases." Mize based his ruling on state law in deciding whether a jury should determine if two men killed in a 1983 accident in Altamonte Springs might have lived had they used seat belts. He also decided a jury should not speculate on the kind of injuries that might have occurred in determining whether to award money to the estates of the two men. The seat belt issue came up last week in a wrongful death suit against CSX Transportation railroad company, the state Department of Transportation and an Apopka man, Richard Jones III, 20. Jones' car collided with another vehicle just east of the railroad crossing at State Road 436 on July 30, 1983. The crash killed Joseph J.

Zeman, 17, of New Port Richey, who was a passenger in Jones' car, and Charles D. Rosenheimer, 51, of Forest City. The case is set for trial April 6. State law says jurors may reduce damages awarded to a traffic accident victim who lived and was found partially negligent by not using a seat belt. However, Fred Peed, who represents the relatives of Rosenheimer and Zeman, said the law does not apply in wrongful death cases because testimony about what injuries might have occurred if the seat belts had been used would be speculative.

He claims in the lawsuits that Jones was negligent for speeding and driving recklessly on the rain-slick highway. Jones lost control of the car, which crossed the median and the railroad crossing and hit Rosenheimer's vehicle. Peed said CSX and the DOT were negligent for failing to properly build and maintain the crossing, which also contributed to Jones losing control of his car.
